PRIVACY POLICY AND CONSENT TO DATA USE

Thank you for your interest in our website “EmpowHer” (www.empowher.at).

Protecting your privacy is very important to us. The transparent and legally compliant collection, processing and use of your personal data (e.g. name, address, e-mail addresses, user behavior) is therefore important to us. In the following we will therefore inform you in detail about the handling of your data.

By agreeing to the following data protection declaration, you (as the "user" / "user") consent to EmpowHer (hereinafter referred to as "EmpowHer" and/or "we") collecting, processing and using your personal data and non-personal data in compliance with data protection laws and the following provisions.

When you contact us, the data you provide will be stored by us in order to answer your questions. We delete the data arising in this context after the storage is no longer necessary, or restrict the processing if there are statutory storage obligations.

 2. Personal Data

"Personal data" means data that relates to an identified or identifiable person. This includes, for example, name, address, e-mail address or telephone number, as well as online identifiers (IP addresses).

The user can use the basic functions of EmpowHer without disclosing personal data, with the exception of the IP address. The disclosure of all other personal data is expressly on a voluntary basis. All data processing related to personal data is carried out exclusively using pseudonymised data. Excluded from this are direct actions related to the individual user, such as correspondence between EmpowHer and the user or other measures affecting the individual user on the part of EmpowHer.

Apart from the IP address, EmpowHer only collects and processes that personal data that the user can voluntarily provide when filling out forms on our website (registration, newsletter subscription, contact form, etc.) or at any other time in the user profile, as well as Your password. Unless otherwise stated in this data protection declaration, your personal data will not be passed on to third parties unless you have expressly given your consent or we are obliged to disclose it, for example due to a court or official order. We will protect your personal data as best we can against unauthorized access by third parties.

EmpowHer collects personal data to improve and promote our services, to provide all services and possibilities of EmpowHer  , to customize the offer, to provide and manage your account, to contact you and for our own marketing and advertising purposes. EmpowHer can only keep its full user promise by processing data, as many services would otherwise not be usable. Statistical evaluations and scientific research regarding target group analyses, market analyzes and other topics are only carried out with the aim of non-personal results and using pseudonymised data. The results of these statistical evaluations as well as market and opinion research can also be passed on to third parties. We never store answers from surveys or other data collected from market and opinion research together with your e-mail address or other personal data.

The use of data for statistical evaluations as well as market and opinion research can be objected to at any time in writing by e-mail, by letter (we do not assume any shipping costs) or via our online contact form. Our contact details can be found in our imprint.

All personal data collected by EmpowHer will be retained for as long as is necessary to achieve the underlying purposes. This duration can result from special legal regulations.

EmpowHer never collects sensitive data from users and would never ask for it.

Persons under the age of 14 may not transmit any personal data to us without the consent of their parents or legal guardians.

The protection of the personal data provided by the user has the highest priority for EmpowHer . EmpowHer  therefore endeavors to ensure compliance with data protection. In addition, we take other state-of-the-art measures to protect your personal data.

3. Collection, storage and use of personal data

3.1 When visiting our website

When you visit our website www.littlegardeneden.com, the browser used on your device automatically sends information to our website server. This information is temporarily stored in a so-called log file. The following information is recorded without your intervention and stored until it is automatically deleted:

  • IP address of the requesting computer,

  • date and time of access,

  • name and URL of the retrieved file,

  • Website from which access is made (referrer URL),

  • Browser used and, if applicable, the operating system of your computer and the name of your access provider.

The data mentioned are processed by us for the following purposes:

  • Ensuring a smooth connection establishment of the website,

  • Ensuring comfortable use of our website,

  • Evaluation of system security and stability as well

  • for other administrative purposes.

The log files contain IP addresses or other data that enable assignment to a user. This could be the case, for example, if the link to the website from which the user arrives at the website or the link to the website to which the user switches contains personal data.

The legal basis for data processing is Art. 6 Para. 1 S. 1 lit. f GDPR. Our legitimate interest follows from the data collection purposes listed above. Under no circumstances do we use the collected data for the purpose of drawing conclusions about your person.

The data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended.

If the data is stored in log files, this is the case after seven days at the latest. Storage beyond this is possible. In this case, the IP addresses of the users are deleted or alienated so that it is no longer possible to assign the calling client.

In addition, we use cookies and analysis services when you visit our website. More detailed explanations can be found under Section 3 et seq. of this data protection declaration.

 

3.2 When using other functions and offers of our website

In addition to purely informational use, we offer various services that you can use if you are interested. To do this, you usually have to provide additional personal data that we use to provide the respective service.

a) Registration for our newsletter

If you have expressly consented in accordance with Art. 6 Para. 1 S. 1 lit.a GDPR (we use the double opt-in procedure to register for our newsletter), we will use your e-mail address to send you regular information to send our newsletter. To receive the newsletter, it is sufficient to provide an e-mail address.

You can unsubscribe at any time, for example via a link at the end of each newsletter. Alternatively, you can send your unsubscribe request at any time to erika@empowher.at   by e-mail or use the unsubscribe function in the newsletter.

We can also pass on your e-mail address to third parties if this is necessary for sending the newsletter. The legal basis for this is Art. 6 Para. 1 S.1 lit.a DSGVO.

 

b) Use of our shop

If you would like to place an order in our "EmpowHer" web shop, it is necessary for the conclusion of the contract that you provide your personal data, which we need to process your order. Mandatory information required for the processing of the contracts is marked separately, further information is voluntary. We process the data you provide to process your order. For this purpose, we can also pass on your payment data to third parties (e.g. transport companies, logisticians, banks, payment providers), insofar as this is necessary for order and order processing.

Finally, we need your e-mail address so that we can confirm receipt of your order and communicate with you, in particular to send you technical information in connection with your order. The legal basis for this is Art. 6 Para. 1 S.1 lit.b DSGVO.

Due to commercial and tax regulations, we are obliged to store your address, payment and order data for a period of 10 years.

 

2.3 Disclosure to Third Parties

If we use external service providers to process your data, they have been carefully selected and commissioned by us. You are also bound by our instructions by concluding order data processing contracts in accordance with Art. 28 GDPR and are regularly checked by us.

In general, we only pass on your personal data to third parties if:

  • you have given your express consent in accordance with Article 6 Paragraph 1 Sentence 1 Letter a GDPR,

  • the transfer according to Article 6 paragraph 1 sentence 1 lit. f GDPR is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data,

  • in the event that there is a legal obligation for the transfer according to Art. 6 Para. 1 S. 1 lit

  • this is legally permissible and required for the processing of contractual relationships with you in accordance with Article 6 (1) sentence 1 lit. b GDPR.

 4. Consent to data transfer to third countries

In order for EmpowHer to provide its services, EmpowHer uses the support of service providers from third countries. In order to enable EmpowHer to provide this service, I consent to EmpowHer sending the required information on data processing and use in third countries to the categories of recipients listed below. I am aware that third countries have lower data protection requirements than the member states of the European Union.

For the purpose of mediation, all of the data mentioned in Section 2 of this data protection declaration, which may also be personal, may be transmitted.

Recipients within the meaning of this declaration of consent are service providers via which EmpowHer sends e-mail messages and service providers who offer EmpowHer server storage.

The above declaration of consent is voluntary and can be revoked at any time for the future.

If I do not agree to the use and transmission of data, I will not register on www.littlegardeneden.com and I will not log on to www.littlegardeneden.com and no data will be transmitted.

5. Use of Cookies

EmpowHer uses cookies. By using our platform, you agree that cookies may be used.

EmpowHer uses cookies to recognize the end device you are using or you as a user, to be able to offer you special services, for research and diagnostics with regard to improving content, as well as to improve security and prevent fraud attempts. Furthermore, we can evaluate anonymously how many users visit our platform and what content is viewed and how often.

6. Analysis Tools

The tracking measures listed below and used by us are carried out on the basis of Article 6 (1) sentence 1 lit. f GDPR. With the tracking measures used, we want to ensure a needs-based design and the continuous optimization of our website. On the other hand, we use the tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

The legal basis for the processing of personal data using cookies for analysis purposes is Article 6(1)(a) GDPR if the user has given their consent.

 

6.1 Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC , for the purpose of designing our pages to meet needs and continuously optimizing them.(https://www.google.de/intl/de/about/) (1600 Amphitheater Parkway, Mountain View, CA 94043, USA; hereinafter "Google"). In this context, pseudonymised user profiles are created and cookies (see Section 4) are used. The information generated by the cookie about your use of this website such as

  • browser type/version,

  • operating system used,

  • referrer URL (the previously visited page),

  • host name of the accessing computer (IP address),

  • time of server request,

are transferred to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage for the purposes of market research and the needs-based design of these websites. This information may also be transferred to third parties if this is required by law or if third parties process this data on our behalf. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymized so that an assignment is not possible (IP masking).

As an alternative to the browser add-on, especially for browsers on mobile devices, you can also prevent Google Analytics from collecting data by clicking on this link. An opt-out cookie will be set to prevent future collection of your data when you visit this website. The opt-out cookie is only valid in this browser and only for our website and is stored on your device. If you delete the cookies in this browser, you must set the opt-out cookie again.

6.2 Google Adwords Conversion Tracking

We also use Google Conversion Tracking to statistically record the use of our website and to evaluate it for you in order to optimize our website. Google Adwords places a cookie (see section 3) on your computer if you have reached our website via a Google ad.

These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer's website and the cookie has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page.

Each Adwords customer receives a different cookie. This means that cookies cannot be tracked via the websites of Adwords customers. The information obtained using the conversion cookie is used to create conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers are informed of the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information with which users can be personally identified.

7. Facebook Remarketing

We use the remarketing function “Custom Audiences” from Facebook Inc. on our website. This function is used to present interest-based advertisements (“Facebook Ads”) to visitors to our website when they visit the Facebook social network. For this purpose, the Facebook remarketing tag was implemented on our website. This tag is used to establish a direct connection to the Facebook servers when you visit the website. It is transmitted to the Facebook server that you have visited our website and Facebook assigns this information to your personal Facebook user account.

8. Google AdSense

Our website uses the online advertising service Google AdSense, through which advertising tailored to your interests can be presented to you. We are interested in showing you advertisements that may be of interest to you in order to make our website more interesting for you. For this purpose, statistical information about you is recorded, which is processed by our advertising partners. These advertisements can be recognized by the reference "Google ads" in the respective ad.

By visiting our website, Google receives the information that you have accessed our website. To do this, Google uses a web beacon to place a cookie on your computer. The data specified in Section 2.1 will be transmitted. We have no influence on the data collected, nor do we know the full extent of the data collection and the storage period. This website does not serve third-party ads through Google AdSense.

9. Plugin

a) Facebook and Instagram

Our websites contain plugins from the social network Facebook (Facebook Inc., 1601 Willow Road, Menlo Park, California, 94025, USA). For example, this plugin shows the Facebook logo. As soon as you visit our site, a direct connection is established between your browser and the Facebook server with the help of these plugins. This means: Facebook learns that our website was accessed from your IP address.   • in accordance with Art. 16 GDPR, to immediately request the correction of incorrect or incomplete personal data stored by us;

  • According to Art. 17 GDPR, to request the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims is required;

  • pursuant to Art. 18 GDPR, to request the restriction of the processing of your personal data if you dispute the accuracy of the data, the processing is unlawful, but you refuse to delete it and we no longer need the data, but you use them to assert, exercise or defense of legal claims or you have objected to the processing pursuant to Art. 21 GDPR;

  • in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request transmission to another person responsible;

  • pursuant to Art. 7 Para. 3 GDPR, to revoke the consent you have given to us at any time. As a result, we are no longer allowed to continue the data processing based on this consent for the future and

  • to complain to a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or work or our company headquarters.

 

11. Right of objection and revocation

If your personal data is processed on the basis of legitimate interests in accordance with Article 6 Paragraph 1 Clause 1 Letter f GDPR, you have the right to object to the processing of your personal data in accordance with Article 21 GDPR, provided that there are reasons for this, which arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right to object, which we will implement without specifying a particular situation.

If we process your personal data on the basis of your consent in accordance with Article 6 Paragraph 1 Clause 1 Letter a GDPR, you can revoke this Article 7 Paragraph 3 GDPR at any time with effect from the time of the revocation.

12. Data Security

When you visit our website, we use the widespread SSL (Secure Socket Layer) method in connection with the highest level of encryption supported by your browser. This is usually a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is being transmitted in encrypted form by the closed representation of the key or lock symbol in the lower status bar of your browser.

We also use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

 

13. Updating and changing this data protection declaration

This data protection declaration is currently valid and has the status of May 2018.

Due to the further development of our website and offers on it or due to changed legal or official requirements, it may become necessary to change this data protection declaration. We receive anonymous statistics from Facebook about the use and usage of the page. The following information is provided here, for example:

  • Followers: Number of people who follow us - including growth and development over a defined time frame.

  • Reach: Number of people who see a specific post. Number of interactions on a post. From this it can be deduced, for example, which content is better received in the community than others. 

  • Ad performance: How much does a click cost us? How many people saw an ad? 

  • Demographics: Average age of visitors, gender, place of residence, language. 

We use these statistics, from which we cannot draw any conclusions about individual users, to constantly improve our online offer on Facebook and to better respond to the interests of our users. We cannot link the statistical data with the profile data of our fans. You can use your Facebook settings to decide how targeted advertising is displayed to you. 

We receive personal data via Facebook if you actively communicate this to us via a personal message on Facebook. We use your data (e.g. first name, surname, chassis number) to answer your request in our customer service. Your data will be stored in our CRM system for this purpose. We also receive personal data via Facebook if you use a form with pre-filled fields with data from your profile to transmit the data to us and actively send the data to us by clicking on a button.

We use this data, which is available in aggregate form, to make our posts and activities on our Facebook page more attractive to users. For example, we use the distribution by age and gender for an adapted address and the preferred visiting times of the users for a time-optimized planning of our contributions. Information about the type of end devices used by visitors helps us to adapt the posts to it in terms of visual design.
